EPA’s New Proposal on Hazardous Substance Spill Prevention

On June 15th, the U.S. Environmental Protection Agency (EPA) Administer Scott Pruitt signed a proposed regulatory action which establishes that no additional regulatory action will take place under the Clean Water Act (CWA) section 311(j)(1)(C) authority for CWA hazardous substances (HS) discharges prevention. This proposal was made after evaluating the existing regulations and their effect on hazardous substance spills- both their frequency and their overall impacts. After analyzing these effects, the EPA has decided that no further regulatory action is required under the CWA.
