NLRB Reports Unfair Labor Practices Filings up 10% in Fiscal Year 2023

Since the provisions of the COVID pandemic ended in 2021-2022 and Americans have fully returned to the workforce, filings for unfair labor practices and union petitions have steadily increased. New data released by the NLRB showed that in Fiscal Year (FY) 2023, 22,448 cases were filed, a 10% increase since 2022. This has been the highest number of cases filed since FY 2016. 19,854 Unfair Labor Practices charges (ULP) were filed in FY 2023, increasing by 10% from FY 2022. There was also a 3% increase of union representation petitions in FY 2023 from FY 2022; this was following a 53% increase from FY 2021 to FY 2022. The NLRB has stated that the increased workload on both sides of the Agency is a challenge, and comes as the NLRB continues to deal with funding and staffing shortages.
