The Global Cold Chain Alliance (GCCA) has joined a coalition of supply chain stakeholders in opposing a petition to delay the implementation of the Detention and Demurrage Billing Requirements Final Rule. This rule, part of the Ocean Shipping Reform Act of 2022, aims to bring clarity and transparency to detention and demurrage billing practices. In a letter to Secretary Eng, the coalition emphasized the importance of maintaining the current implementation timeline, which took effect on May 28, 2024, following a 90-day preparation period.

The letter highlights that stakeholders have already adjusted their systems and business practices to comply with the new rule. Any delay at this point would lead to significant disruptions and potential chaos in the marketplace. The letter also pointed out that the rule’s preamble clarification did not alter the underlying requirements, further underscoring that a retroactive delay is unwarranted. The coalition urges the Commission to reject the petition, emphasizing the need to uphold the principles of clarity and fluidity in port and terminal operations as intended by the Ocean Shipping Reform Act.
