On June 13th, the Biden Administration’s Office of Management and Budget (OMB) released its updated Unified Regulatory Agenda.  The release comes approximately two months later than scheduled and shows the Administration has aggressive plans to advance regulations, many of which would be finalized by spring 2024.  The Administration must consider the timing, as rules finalized later in 2024 could ultimately be subject to the Congressional Review Act resolutions should Republicans win the White House and maintain control of one (or both) chambers in Congress.  The Unified Regulatory Agenda covers regulations across all of the federal government and sets timing goals for their completion. Of particular interest to the cold chain are rulemakings to revised the EPA Risk Management Program (Final Rule scheduled for December 2023), EPA AIM Act Regulation to phase down HFCs (Final Rule expected September 2023) and OSHA’s Process Safety Management (still in Pre-rule stage, with analysis of comments to be completed by November 2023).
